When I first saw this article, I thought that this is just another way that Democrats want to control and demagogue the Republicans. But thanks to an article by Katie Pavlich of TownHall, she breaks down the legality of this type of corrupt political machine.

Someone in the Obama presidential campaign thinks that by collecting email addresses of Republicans from their supporters is a “fun” idea. However, this is just a way to build a database that would enable Democrats to target Republican voters during the general election campaign. It could also become part of a Democratic effort to influence Republican primary voters to select a candidate that Democrats think Obama could most easily defeat. The email asks their supporters to send them the email addresses of their Republican friends to Obama’s 2012 election campaign web site.

Now you would think that these “government officials” from his campaign would know that this is a violation of federal law, Can Spam Law. The law says that a business cannot spam your email box if you did not give them your email address. It is illegal for them to send you a single email unless you personally signed up for it. Thus this is illegal for the Obama campaign to spam your inbox without your permission.

In addition, the CAN-SPAM Act doesn’t apply just to bulk email. It covers all commercial messages, which the law defines as “any electronic mail message the primary purpose of which is the commercial advertisement or promotion of a commercial product or service,” including email that promotes content on commercial websites. The law makes no exception for business-to-business email. That means all email – for example, a message to former customers announcing a new product line – must comply with the law.

Each separate email in violation of the CAN-SPAM Act is subject to penalties of up to $16,000, so non-compliance can be costly.

But then we are talking about the DNC Chair headed by our most favorite Congresswoman Debbie Wasserman Schultz. She thinks all Democrats are above the law. And then we have the Justice Department, headed by Eric Holder, who will weasel his way around this one in the name of Obama’s re-election. Then of course there is Obama who thinks he is above the law and loves Executive Orders.
